The Drug Enforcement Administration (DEA) along with local law enforcement will be hosting another collection event. This event is an opportunity for the public to prevent pill abuse and theft by ridding their homes of potentially dangerous expired, unused, and unwanted prescription drugs.

What are Pharmaceuticals and Personal Care Products (PPCPs)?

Pharmaceuticals and personal care products (PPCPs) comprise a diverse group of chemicals including, but not limited to, prescription and over-the-counter human drugs, veterinary drugs, diagnostic agents, nutritional supplements, and other consumer products such as fragrances, cosmetics, and sun-screen agents. 1,2,3,4 The term PPCPs refers to the products we use for personal health or cosmetic reasons. 2 We swallow them, rub them on to our skin, have them injected or administer them to our pets. We get them with a prescription or purchase them over the counter.

Why is DTSC Interested in PPCPs?

PPCPs are an emerging issue. PPCPs can be introduced into the environment through many routes. 1,3,4 Treated and untreated domestic sewage containing excreted PPCPs and their metabolites following human use represents an important source of these compounds in the environment. Other sources which can potentially introduce PPCPs into the environment include: leaching from landfills following disposal of expired and unused products; disposal of expired and unused PPCPs in the toilet; release of unabsorbed externally applied PPCPs (e.g. lotions) to surface waters from activities such as swimming; excreta from animals including pets and other domestic animals; use of sewage solids and manure for soil amendment and fertilization; and industrial manufacturing waste streams.

How are These Chemicals Affecting the Environment?

The U.S. Geologic Services has reported that PPCPs such as steroids, prescription and nonprescription drugs, antibiotics, hormones, and fragrances have been detected in water samples collected from streams considered susceptible to contamination from various wastewater sources such as those downstream from intense urbanization or livestock. 5 Potential risk to aquatic organisms due to exposure to PPCPs in the environment has been identified as a primary concern given that aquatic organisms may be continually exposed to chemicals, including multi-generational exposures. 2,3 There is also concern for subtle effects on ecological receptors when exposed to low concentrations. For humans, consumption of potable water which may contain trace concentrations (in the part per trillion to part per billion) of various PPCPs has been identified as one of the primary potential routes of exposure. 5 To date, much research has focused on the potential for pathogen resistance to antibiotics and endocrine distribution by natural and synthetic sex steroids. 2,3 At this time, many unknowns remain regarding the potential for adverse effects on ecological receptors and humans from exposure to PPCPs in the environment. As new information becomes available, this will facilitate more detailed evaluations of the potential toxicological significance of the detection of PPCPs in the environment. What are the Regulatory Issues Associated with Pharmaceutical Management?

For a long time, the regulatory distinction between hazardous waste (as defined in the law and by U.S. EPA and DTSC in regulation) and medical waste (with its own definitions) has hampered a truly environmentally-protective approach to the very complex issues surrounding pharmaceutical management. Only recently have environmental agencies begun to grapple with these issues. There are many levels of this very complex problem that, as a multi-media, multi-disciplinary scientific agency, DTSC intends to explore. More about the regulatory issues around pharmaceutical management.

How Can I Reduce or Prevent Releases of This Waste to the Environment?

Educate ourselves, family members, friends and coworkers about this emerging environmental issue. DTSC created this web page as an information portal on this topic and related subjects.

For most of us, we have been trained to get rid of old or unwanted drugs by flushing them down the toilet. This practice evolved from our desire to keep potentially dangerous drugs out of the hands of others, especially children. However, recent research is showing that this may be the least environmentally friendly method of disposing of old or unwanted drugs. The proper disposal practice may vary depending on county you live in or the wastewater agency that serves your region. Before disposing of old or unwanted drugs, consult your local wastewater agency or household hazardous waste center on the proper disposal practice for your area.

Other actions you might consider to reduce the amount of PPCPs entering the environment are to store your medications properly so they will be useful until their established shelf life. Pay attention to the storage instructions just as you do the dosage instructions.

For old or used pharmaceuticals, currently there is not a best pollution prevention alternative, elimination or substitution. Practice Greenhealth has a web page with information regarding pharmaceutical wastes from health care facilities.

Other DTSC Associated Activities

The Office of Pollution Prevention and Technology Development (OPPTD) is preparing the first SB14 Assessment Report on the pharmaceutical industries’ efforts to reduce hazardous waste. The pharmaceutical industry assessment report will profile each of the 27 California facilities captured by SB14 and listed under Standard Industrial Classification (SIC) 2833, 2834, 2835, and 2836. Each profile will contain individual facility site information, its major waste stream reduction accomplishments from 1999 to 2002 and their projections for further reducing these major waste streams from 2003 to 2006. There is also a program for students with no prior nursing education, and LVNs can also apply for advanced placement into this program. Admission to this program is very competitive – only 40 students are accepted each spring and fall, and California non-residents are only accepted if slots cannot be filled by eligible state residents. Applicants must have completed at least four of the eight program prerequisite courses when they apply, and the remaining courses must be in progress. Students learn the fundamentals of nursing through classroom lessons, clinical experience and practice at the Rural Northern California Clinical Simulation Center.

The program includes classes in pharmacology, obstetrics, nursing for adults, nutrition and mental health nursing. You’ll study research methods and you must complete a senior project to graduate.

Options to Respond

If you have been served with a summons and a petition, you are the respondent in a court case for divorce or legal separation.

When you are served, read the papers you have received carefully. The Petition (Form FL-100 ) tells you what the petitioner (your spouse or domestic partner) is asking for. The Summons (Family Law) (Form FL-110 ) gives you important information about your rights and the divorce or separation process. It contains some standard restraining orders limiting what you can do with your property, money, and other assets or debts. It also prohibits you or your spouse or partner from moving out of state with your children from your marriage or partnership, and from applying for a new or replacement passport for any of your children together, without the prior written consent of the other or a court order. READ this form carefully!!

Once you are served, you have several options:

  1. You can do nothing — which means that whatever your spouse or domestic partner is asking for in the Petition will probably be granted. The judge will base his or her decision about property, support, and custody and visitation (if you have children together) only on what your spouse or domestic partner has requested in the Petition.
  • This situation is called a “true default” because you are “defaulting” by not responding and are not involved at all.
  • In a “true default” you are giving up your right to participate in the case.

  • You can do nothing because you have a written notarized agreement with your spouse or domestic partner where you both agree to end your marriage or domestic partnership. And you agree about other things like the division of your property and your debt, spousal or partner support, and, if you have children together, child support and custody and visitation orders.
    • In this case, you also “default” because you are not filing a response.
    • BUT you are having a say in the final outcome because you are reaching a written agreement with your spouse or domestic partner. So this is a “default with agreement” case.

  • You file a response with the court but also reach an agreement with your spouse or domestic partner about all the issues.
    • If you choose this option, it is considered an “uncontested” case because you and your spouse or domestic partner are not fighting over the issues. You are agreeing to the terms of your divorce or legal separation.

    Compared to Los Angeles car insurance rates, San Diego’s are hundreds of dollars less, but still not cheap. The same driver will pay hundreds of dollars more in Coronado than in Carlsbad, according to our California car insurance rate analysis. But even if you live in one of the higher-cost ZIP codes, you can save money by simple comparison shopping. No two car insurance companies will offer you the same rate.

    San Diego ZIP code 92135 is the most expensive for car insurance in the city, $1,467 a year, according to a survey of rates from six major carriers. But the difference between the highest rate ($1,703) for that ZIP and the lowest ($1,130) is $573.

    Why comparing car insurance rates saves you money

    Prices for the same policy vary by hundreds sometimes thousands of dollars because no two insurance companies us the same formula to calculate rates. That s why you have to shop around to save money. To see how car insurance rates compare, use our average rates tool below.

The rate includes uninsured motorist coverage.
    Averages for customized rates are based on drivers ages 20, 30, 40, 50, 60 and 70 for the following coverage levels: state minimum liability, liability of 50/100/50 and 100/300/100 with $500 deductible on comprehensive and collision. These hypothetical drivers have clean records and good credit. Average rates are for comparative purposes.
    Your own rate will depend on your personal factors and vehicle.

    State Minimum:
    Required liability coverage to drive legally in your state; some states mandate additional coverage, such as personal injury protection, uninsured motorist, underinsured motorist.

    Liability Only 50/100/50:
    $50,000 per person/$100,000 maximum per accident for bodily injury; $50,000 for property damage. Liability pays for injuries/damage you cause others.

    Full Coverage 100/300/100:
    $100,000 per person/$300,000 maximum per accident for bodily injury; $100,000 for property damage; comprehensive and collision coverage with $500 deductible. Liability pays for injuries/damage you cause others. Comprehensive and collision pay for damage to your car.


    Cheapest car insurance in San Diego

    If you need just enough coverage to drive legally, you ll want to shop for the lowest liability car insurance limits required by the state. In California, (written as 15/30/5) that means your liability car insurance would pay up to:

    • $15,000 for injuries you cause to others
    • $30,000 per accident
    • $5,000 for damage you cause to others cars and property

    The state average rate for a year of minimum coverage is $723, according to our rate analysis. You would pay just $188 more if you hiked your liability coverage to 50/100/50.

    Best car insurance in San Diego

    If you want to have enough car insurance coverage to protect your home and assets, you should buy liability insurance in the following amounts:

    • $100,000 to pay for others medical bills
    • $300,000 to pay for injuries to others in an accident you cause
    • $100,000 to pay for damage to others property

    You should also consider buying these optional coverages:

    • Comprehensive, which replaces stolen cars and covers damage to your car from floods, fire, hail, vandalism.
    • Collision, which pays for damage to your car from accidents.

    Comprehensive insurance and collision coverage pay out up to the actual cash value of your car. In California, comprehensive costs $98 and collision costs $361, on average per year, according to the Insurance Information Institute. These two coverages come with a deductible. That s the amount you pay for each claim before your insurer pays out. Deductibles of $1,000, $500 and $250 are the usual amounts from which you can choose. The lower the deductible is, the higher your rate will be.

    Public transportation: The U.S. Census Bureau says that the majority of riders in San Diego who commute to work by public transportation are white (about 29 percent), Hispanic (about 43 percent) and black (about 9 percent). The bureau notes that commuting is the main reason people use mass transit.

    Smog rules: All California residents much have their vehicles tested for emissions at a licensed smog testing center every two years to renew registration. Vehicles that are six years old or less are exempt from testing. New California residents must have an initial inspection to have their vehicle registered, even if they have a current smog certificate from their previous state.

    Bad intersection: Where 54 th Street and University Avenue meet is considered one of the worst intersections in San Diego, with 77 accidents reported during the past ten years.

    On a monthly basis one of our Board Certified Behavior Analysts (BCBA) holds a topic based 1-2 hour workshop at our center in Salida. Parents/caregivers and families of clients receiving any of our comprehensive services are welcome to attend for free. Topics vary form month to month and some more popular topics are repeated more than once a year as requested. Preparation for these presentations always involves a review of current research and is founded in basic applied behavioral principles. The information is however presented to parents and caregivers in a very user-friendly format with the use of limited professional terminology that might overwhelm parents and caregivers. Positive behavioral strategies that are developmentally appropriate are presented.

This class is user-friendly and a variety of real life examples across behaviors and ages are shown through videos and vignettes. Parents/caregivers actively participate as the instructor continually presents ASR s (Active Student Responding activities) where parents are asked to problem solve and demonstrate their understanding of the information throughout the class.

    It is crucial that parents participate on some level in treatment so that skills can generalize and maintain over time. Typically the parent/caregiver is briefed weekly and is asked on a weekly basis to participate in what we refers to as Phase 3 where we begin to generalize the current skills being taught. Target skills are generalized systematically so that the child can utilize the skill regardless of the how it is presented (Phase 2) or the environment, or who presents it (Phase 3). Parents/caregivers play a key role in assisting therapists transfer skills in the final phase of skill acquisition (Phase 3).


    [Our child] is able to listen and work on tasks for 25 minutes or more. His eye contact is 100% better. He is able to understand English and Spanish. He has also started talking. He responds to his name, and has better behavior throughout the day.

    Overview of our MA in Film and Media Production

    The Academy makes the accelerated schedule possible by creating an extended academic year, allowing students to complete three full-length semesters in one calendar year.

    New York Film Academy MA degree programs are offered only at our Los Angeles campus.

    Throughout the filmmaking MA program each student writes, shoots, directs, and edits eight films, and works on at least 20 more.


    The New York Film Academy Master of Arts (MA) in Film & Media Production is a three semester accelerated graduate program. Designed to educate aspiring content creators, it is a hands-on, total immersion, professional course of study. Each student will create eight of their own film media projects in an array of formats and genres. They will work in collaboration on their classmates’ projects on at least 20 more. The capstone of the MA Film and Media Production program is a written thesis paper exploring the ideas and themes that are studied during the course of the entire program. MA students will have opportunities to develop and deepen their thesis papers in the second semester of their studies in Thesis Development class, under the expert guidance of NYFA’s professionally active faculty. Students will then progress to finalize their thesis work in the third semester, in Thesis Review.

    Film and media production is constantly evolving in the 21st century — and so is the New York Film Academy’s filmmaking Master’s program. NYFA’s filmmaking MA program provides creative visual storytellers with the skills needed to thrive and succeed. The intensive curriculum challenges students, develops their skills, and prepares them for the new and evolving production world of today. Students will gain experience shooting their projects on the newest in HD, film, and digital equipment, from Canon 5D to Red Dragon, as well as classic film cameras like Panavision and Arriflex.


    MA Filmmaking students begin their immersion in film production through a series of intense classes in directing, screenwriting, cinematography, and editing. These classes support a number of short film productions that quickly put students’ skills into practice and assist them with developing proficiency in the overall production process. Each student will direct four short film/media projects in the first half of the semester.

    Students will also develop their leadership and collaborative skills through fulfilling the essential roles of Director of Photography, Assistant Camera Operator, and Gaffer (Lighting Technician) on the films of their classmates.

    Dialogue production is explored in depth in the second half of the semester while classes in directing, screenwriting, and editing continue. The final project of the semester is the digital dialogue film, which students will write, direct, and edit.

    Throughout the semester students are immersed in a course about the changing formats of media production in today’s entertainment marketplace. This course prepares them to undertake production of their thesis film in semester two either as a short film or as a new, still developing format, such as webisode, or content for mobile applications.

    The combination of these classes will prepare students for the second semester and production of their Thesis Projects.


    • Art, aesthetics, and technique of visual storytelling including directing, cinematography, and editing.
    • Fundamentals of film production and digital editing.
    • Survey and examination of contemporary media formats and distribution vehicles from a content creator’s perspective.
    • Fundamental training in acting and directing actors.
    • Immersion in screenwriting craft.
    • Develop an ability to collaborate with — and lead — a student film crew.


    • Write, direct, and edit four short film/media projects.
    • Crew as cinematographer, gaffer, and/or assistant camera on approximately 12 additional films.
    • Write a short film script with dialogue.
    • Write, direct and edit a dialogue film.
    • Successfully complete Production Lab exercise.


    The second semester of the Master of Arts in film and media production program challenges students to develop their craft artistically and technically, and to progress beyond their earlier achievements with the medium. Building upon the filmmaking foundations learned in the previous semester, students continue with their directing, screenwriting, cinematography, and editing classes.

    Film Production Lab Two, an intensive in the field production class, provides instruction in all of these areas through a series of “in the field” productions. The development of professional on-set conduct, leadership, and collaborative skills are also rigorously developed in this class.

    The branding and marketing required to make an entrance into the crowded contemporary media field is studied at length prior to production of the thesis project. This allows students time to acquire any provisions they need to successfully promote the project.

    The last film project of the filmmaking MA is the Final Film: a single production of up to 15 minutes in length, or multiple shorter media projects. It may be a short film intended for film festivals and distribution which incorporates all of the disciplines instructed throughout the semester, or a new format as studied in the Media and Society class. Current examples include webisodes, branded entertainment, short TV pilots, or commercials. The students’ ambitions and capabilities as evidenced in the thesis project are expected to increase from the first semester projects. Students will also expand their knowledge of production and collaborative abilities through acting as crew members on five of their classmates’ productions.

    Intensive classes in post-production assist the student not only with completing the final steps of the filmmaking process, but also with developing an ability to give and receive editorial and creative feedback on their project.


    • Advance in proficiency in the fields of directing, editing, and cinematography.
    • Develop an increased ability to produce short films at a higher level.
    • Advance in proficiency in collaboration and leadership skills.
    • Acquire a comprehension of branding and marketing as required to promote the thesis project.
    • Develop an ability to give and receive constructive editorial and creative feedback on a project.


    • Direct and edit a thesis project of up to 15 minutes in length (shot on 16mm film, 35mm film, or High Def).
    • Develop proficiency with the second semester equipment package.
    • Participate as a principle crew member in five fellow students’ films.
    • Direct or DP a Film Production Lab Two project.


    The thesis project will be presented in a movie theater for an invited audience. Students are responsible for inviting all guests. This public screening is not part of the formal evaluation process, but serves as a celebration of the students’ progress and achievements thus far.

    Introduction to Newport Beach

    Incorporated in 1906, the Pacific coastal city of Newport Beach, California, is situated in Orange County, 10 miles south of downtown Santa Ana and 17 miles south of Anaheim. Bordering the city is Huntington Beach to the west, Costa Mesa and Irvine to the north and Crystal Cove State Park to the east. Newport Beach is home to several well known communities, including Corona del Mar, Balboa Island, Newport Coast, San Joaquin Hills and Balboa Peninsula (also known as Balboa).

    In 1870, Captain Samuel S. Dunnells successfully steered his 105-ton river steamer, the “Vaquero,” through upper Newport Bay, dispelling the prevalent theory at the time that the bay was too treacherous for travel. The harbor was named a “New Port” by the principal landowners in the area, James and Robert McFadden, who created McFadden’s Landing and a few years later, McFadden’s Wharf. By the early 1900s, Newport Beach had already become a tourist destination with the arrival of the Pacific Electric Railway, which terminated at the Balboa Pavilion. By the mid-20th century, a number of famous celebrities would call Newport Beach their home. One of the most recognizable was John Wayne (known as “the Duke”). Other area celebrities over the years have included Shirley Temple, James Cagney, Humphrey Bogart, Errol Flynn, Roy Rogers, Joey Bishop and George Burns. Today, Newport Beach remains very much a tourist destination, possessing a harbor crowded with boats, streets busy with shoppers and 6.2 miles of beaches filled with surfers and swimmers.

    Visitors to Newport Beach will never be at a loss for things to do, places to go or sights to see. True to its name, the city offers numerous beaches to suit every beachgoer’s taste, among them the Wedge (a body-surfing hot-spot). Other outdoor attractions include:

    Orange County is home to several world-class attractions that are located outside the city borders of Newport Beach but still within easy commuting distance. These include Disneyland and Disney’s California Adventure Park (Anaheim), Knott’s Berry Farm Knott’s Soak City (Buena Park), the International Surfing Museum (Huntington Beach), the Orange County Zoo (Orange), the Wild Rivers Waterpark (Irvine) and the Marconi Automotive Museum (Tustin).

    Orange County is also home to several pro sports teams. Baseball fans can watch Major League action when the Los Angeles Angels of Anaheim play their home games.     California DUI: What are the Penalties?

    What’s the minimum and maximum penalties for a first DUI conviction?

    Assuming there is no bodily injury or death resulting from the DUI, the minimum terms for a misdemeanor first conviction are as follows:

    • $390 fine plus over $1,000 in ordinary penalty assessments, plus additional DUI-only assessments for a total of approxi­mately $1,800.
    • 48-hour jail sentence or a 90-day license restriction allowing you to drive to and from your work—and for work—if required, and to and from an alcohol treatment program. If the 90-day restriction is imposed, it begins after your DMV four-month suspension or 30-day suspension followed by a five-month restriction.
    • Attendance and completion of a $500, three-month alcohol-treatment program (nine months if your blood alcohol level was 0.20% or higher. Completing the program is a requirement for ever being able to drive again following a “per-se” DMV license suspension and for minimizing that suspension to 30 days (plus five or eight months of restricted driving) instead of the six- or ten-month flat suspension that would otherwise be imposed.
    • Loss of your driver’s license for at least 30 days, followed by either a five-month restriction to drive to, from, and for work and to and from an alcohol treatment program, or an additional two-month restriction that allows you to drive only to and from the program.

    The maximum penalties for a misdemeanor first DUI conviction in California is a $1,000 fine plus over $2,600 in penalty ­assessments, six months’ imprisonment in the county jail, a six-month license suspension ; ten months for blood alcohol level of 0.15% or more, having your vehicle “impounded” (stored at your expense) for 30 days, and being required to attach an “interlock” breath device to your vehicle that will not allow the car to start if there is any alcohol on your breath. This will cost you about $800.

    What type of probation is required of a first offender?

    Almost all first-time offenders are placed on probation for three to five years. If you violate any of the terms of your probation, you can face a nonjury hearing where additional penalties can be applied. The standard conditions of probation include: (1) not driving with any measurable amount of alcohol in your system, (2) submitting to a blood or roadside breathalyzer (PAS) test upon the request of a police officer and (3) refraining from further violations of the law (no further misdemeanors — ordinary traffic infractions don’t count).

    What’s the minimum and maximum penalties for a second DUI conviction?

    If no one is injured or killed as a result of the DUI, the minimum penalties a judge will impose for a second DUI conviction (within 10 years of the first DUI) include the following:

    • a $390 fine plus penalty assessments for a total of approximately $1,800
    • ten days or 96 hours (including two 48-hour sessions) in jail
    • completion of an 18- or 30-month second-­offender alcohol-treatment program, which costs about $1,800, as a condition of probation. You must complete this program if you ever want to drive again. Enrollment in this program also allows you to reduce the two-year suspension to one year, followed by a two-year license restriction that allows you to drive to, from, and in your work, and to and from the program—after the first year of suspension, and
    • installation of an “interlock” device on all ­vehicles you own .

    The maximum penalties for a misdemeanor second conviction within ten years of a prior conviction (counted from the date of the previous offense to the date of the second offense) include: a $1,000 fine plus penalty assessments for a total of approximately $3,000, one year in jail, a two-year license suspension by the DMV, impoundment of your vehicle for up to 30 days at your expense, and

    required installation of an “interlock” device on all vehicles you own.

    What’s the minimum and maximum penalties for a third and subsequent DUI convictions?

    Assuming there is no bodily injury or death resulting from the DUI, the minimum penalties are as follows:

    • a $390 fine plus over $1,000 in ordinary ­penalty assessments, plus additional DUI-only assessments for a total of approximately $1,800
    • 120 days in jail for a third offense, 180 days for a fourth offense and
    • revocation of your driver’s license for three years (third offense) or four years (fourth ­offense), and completion of a 30-month multi-offender program to get your license back.

    The maximum penalties for a third and fourth offense within ten years are as follows: a $5,000 fine plus over $13,000 in penalty ­assessments for a total of $18,000, one year in jail for a third offense; 16 months in state prison for a fourth offense, if charged as a felony, impoundment of your vehicle for up to 90 days or even forfeiture and loss of your vehicle, revocation of your driver’s license for three years (third offense) or four years (fourth offense), and a 30-month alcohol treatment program before getting your license restored.

    What happens if someone is killed or injured in a DUI?

    If someone is killed or injured as the result of driving under the influence of alcohol, or while blood alcohol is 0.08% or more, the driver can be found guilty of a felony and could go to state ­prison for over a year, and possibly for up to five years, depending on whether it’s the driver’s first, second, or third offense. Prior convictions for misdemeanor under-the-influence or over-0.08% driving count as prior offenses for the purpose of increasing the prison sentence. So do prior convictions of alcohol-related reckless driving. The jury (and sometimes the judge) will have the option of reducing the offense to a misdemeanor, but even in such cases, the person convicted could still spend up to a year in the county jail—and probably will, since judges take DUI extremely seriously under these circumstances. Also, a person faced with a fourth drunk-driving charge over a ten-year period may be charged with a felony, even where no one was ­injured as a result of the offense.

    Undue Influence

    Undue influence is a key element in financial abuse cases. Almost always, the elderly victim was taken advantage of through coercion, manipulation or trickery and thus lost their property and money to the perpetrator.

    California Civil Code Section 1575 describes undue influence as:

    The use, by one in whom a confidence is reposed by another, or who holds a real or apparent authority over him or her, of such confidence or authority for the purpose of obtaining an unfair advantage over him or her;

    Taking an unfair advantage of another s weaker state of mind; or

    Taking a grossly oppressive and unfair advantage of another s necessities or distress.

    As you can see, taking advantage of an elder is the key theme in financial abuse cases.

    There are numerous ways that the elderly are taken advantage of. One of the most prolific is the improper use of financial powers of attorney. Placed into the hands of a greedy son or daughter, this powerful document can become a license to steal . Here s a quick example:

    Mom had always lived independently and always handled her own finances. She would never relinquish control over her investments or bank accounts. However, over the years she began to develop symptoms of dementia short and long term memory loss. Although she had some friends, none of them felt it was their place to step in and assist her with her financial matters.

    Because of the current economic situation . her son recently lost his job and his bank was threatening to foreclose on his home. He now sees an easy way out. He relentlessly badgers mom until he overpowers her deep-rooted need for independence, and unduly influences her into signing a financial power of attorney by convincing her that she needs help in paying her bills. Son now takes the power of attorney to mom s bank and adds his name on both her checking and savings accounts.

    It isn t long until her accounts are depleted and she never saw it coming because of her diminished mental capacity.

    Under California law, undue influence can be presumed to have occured whenever a special relationship exists between the elder and the perpetrator. Determining whether a special relationship exists involves questions of fact and depends on the circumstances of each case. Such a relationship can be established by the close proximity of the perpetrator to the elderly victim. Caregivers, nurses, friends or relatives can all, potentially, be so involved in the elder s life that such a special relationship exists to trigger the presumption that undue influence occurred.

    The importance of this presumption, once established, is that it shifts the burden to the defendant (the son in the above example) to prove that undue influence did not occur.

    Another factor in determining whether undue influence occurred, it is a determination as to the adequacy of consideration that was given to the elder by the defendant. In making such a determination, the Court will consider the degree of isolation, failing health, and mental capacity of the elder and what benefit, if any, the defendant provided to the elder.

    One more factor is whether or not the elder obtained independent legal advice before executing a power of attorney or completing a conveyance of real or personal property. In most cases of elder financial abuse, the perpetrator did not take steps to have the transaction reviewed by an attorney.

    One of these factors, by themselves, is probably insufficient to show that the elder was subjected to undue influence and that the conveyance of real or personal property should be undone. However, a combination of these factors can be enough to prove undue influence and to convince the court that the power of attorney be declared void, or that the transaction, conveyance or contract should be rescinded and the property wrongfully taken must be returned to the elder.

    Many remedies exist when undue influence has been used to obtain property. California s Elder Abuse and Dependent Adult Civil Protection Act provides nearly every remedy under the sun, and a civil action can request that the defendant be liable for attorney fees, costs, and punitive damages, as well as all special and general damages.

A California lemon law case and claim are predicated upon Repair Order Invoices. These are the proof of your claim and repair attempts. Keep them in a safe place, away from your vehicle.

    Important lemon law rights notice to consumers with vehicles with recently expired factory warranties: If your vehicle is outside of the factory “bumper-to-bumper” or “powertrain” warranty, you may still be eligible for relief under the California lemon law. If you have had four (4) or more repair attempt visits at an authorized dealership for the same issue/problem/complaint before expiration of factory warranty coverage, and have repair order invoice documents that support this (or you get a warranty repair history printout from your dealer), you may be eligible for a substantial cash settlement under the lemon law. If you gave the automobile manufacturer written or verbal notice (telephoned in to Customer Assistance Center) of the continued warranty non-conformity issues during the warranty coverage period and continue to have the same issue/problem/complaint, you may potentially entitled to a repurchase (buyback) of your vehicle, even though it is out of factory warranty. We invite you to call us to discuss your out-of-warranty vehicle’s problems and warranty repairs history. The same applies to “Certified Pre-Owned Warranty” used vehicles, which enjoy the same lemon law protection as new vehicles.

    The California lemon law also requires that the automobile manufacturer pay for the consumer’s hourly attorney’s fees on a case and claim that settles for a repurchase (buyback), new replacement vehicle, or a cash settlement payment. This makes the lemon law economically feasible for consumers who would not otherwise be in a position to hire a lemon law attorney.

    • If you are under the age of 21 and are operating a vehicle after consuming alcoholic beverages. Persons under 21 may not have any alcoholic substances in their vehicle when driving alone. (Exceptions may be made for work-related driving).
    • If you are under the age of 21 and your BAC level is .01 percent or higher.
    • If you are under the age of 21 and are driving after having consumed alcohol in any form. This includes prescription drugs and over the counter medications.
    • If you are over the age of 21 and your BAC level is .08 percent or higher.
    • If you are a commercial driver with a BAC level of .04 percent or higher
    • If you are under the age of 18 and have ANY measurable blood alcohol concentration.
    • If you are a repeat offender and your BAC level is at .01 percent or higher.

    How DUI Offenders are Penalized in California

    If you have incurred a DUI in California and are found guilty, the following are the punishments that you may be issued:

    1st Conviction

    • Imprisonment from 96 hours to 6 months
    • Fines from $1,000 to $1,600
    • Driver’s license suspension for 6 months
    • Mandatory completion of DUI Program
    • Possible court order to install ignition interlock device
    • California SR-22 Insurance required for restricted license

    2nd Conviction

    • Imprisonment from 90 days to 1 year
    • Fines from $1,000 to $1,900
    • Driver’s license suspension for 2 years
    • Mandatory completion of DUI Program
    • May be eligible to apply for interlock ignition device (IDD) restricted driving

    3rd Conviction

    • Will be designated Habitual Offender
    • Imprisonment from 120 days to 1 year
    • Fines from $1,000 to $2,000
    • Driver’s license suspension for 3 years
    • Mandatory completion of DUI Program
    • Mandatory installation of ignition interlock device
    • May apply for restricted driver’s license after 1 year
    • California SR-22 Certificate required for restricted license

    4th Conviction

    • Imprisonment from 180 days to 1 year
    • Fines from $1,000 to $3,000
    • Driver’s license suspension for 4 years
    • Mandatory completion of DUI Program
    • Mandatory installation of ignition interlock device
    • May apply for restricted driver’s license after 1 year
    • California SR-22 Certificate required for restricted license

    Repeat Offenders

    California has a zero tolerance police for repeat DUI offenders. As such, the maximum possible penalty for driving under the influence may be issued to motorists who are convicted. Repeat Los Angeles DUI offenders may be denied application for a restricted license as well. The state of California takes all previous charges into account when issuing penalties for a new one. This may lead to a motorist being charged with a misdemeanor or felony DWI. All repeat DUI punishments are also affected by where the driver was issued the charge as well as the driver’s BAC level at the time of arrest.

    Recent Amendments to California DUI Laws

    As of 2011, California DWI laws have expanded the number of categories by which the Department of Motor Vehicle (DMV) can immediately suspend driving privileges when the motorist is suspected of driving under the influence.

    As of 2010, California law requires the mandatory installation of ignition interlock devices. The state also shortened the time period in which driving penalties are restricted, including those for repeat offenders. In order for the penalty period to be shortened, motorists must pay all required fees and file an SR-22 insurance form.

    California Assembly Bill 91 – Requires that ignition interlock device manufacturers provide information to the Department of Motor Vehicles. Also requires the DMV to establish a pilot program in Alameda, Los Angeles, Sacramento and Tulare that requires a driver to install an interlock ignition device and to participate in alcohol and drug assessment programs.

    California Assembly Bill 1165 (Zero Tolerance Law For Repeat Offenders) – Makes it unlawful for a motorist under probation for a violation to operate a motor vehicle with a BAC level of .01 percent or higher.

    California Senate Bill 1190 (Ignition Interlock Devices) – Lowers the minimum BAC level at the time of arrest to allow a motorist to install an ignition interlock device on their vehicle as well as prohibits said motorist from operating the vehicle without the device.

    California Senate Bill 1388 (Interlock Devices) – Effective July 2009, requires motorists to install an ignition interlock device immediately on their vehicles following conviction of violating DUI provisions as well as driving under a suspended/revoked license due to DUI-related convictions. The number of violations will determine the time period in which the device must remain installed.

    California Assembly Bill 2802 (Reckless Driving) – Court must order DWI convict to participate in a program related to DUI education and treatment. Probation will be revoked if motorist does not enroll in the program.

    Overview of California Domestic Violence Law

    California’s domestic violence laws seek to prevent violence in familial or intimate relationships. The state identifies domestic violence when an individual commits a criminal act within one of the types of relationships specified by the California Penal Code: spouse or former spouse; cohabitant or former cohabitant in a home; a parent with whom the individual has a child; or a partner in a dating relationship. Domestic violence often occurs in tandem with child abuse .

    When a prosecutor charges a defendant with a crime based on domestic violence, several sections of the Penal Code may apply. A prosecutor can choose which criminal charges to pursue based on the severity of the conduct and harm to the victim, along with other circumstances of the case.

    In Section 242, the Penal Code defines battery as a willful and unlawful use of force or violence against the person of another. Section 243(e)(1) of the Penal Code criminalizes battery within one of the specified familial or intimate relationships. Alternatively, a prosecutor can choose to charge the defendant with battery under Section 243(d) if the defendant inflicted serious bodily injury on the victim. Battery under Section 243(d) reflects a greater degree of harm suffered by the victim of domestic violence.

    The Penal Code also criminalizes domestic violence under Section 273.5 when an individual’s willful conduct leads to a corporal injury resulting in a traumatic condition suffered by a person with whom the individual has one of the familial or intimate relationships specified by the domestic violence laws of California.

    California state laws allow victims of domestic violence to apply for emergency protective orders and restraining orders in both civil and criminal court. Issuance of a protective order or restraining order does not necessarily depend on physical harm suffered by the victim — someone who fears imminent harm or who has suffered emotional abuse may still qualify for protection through the California legal system.

    Jury finds passenger was unbelted at time of crash

    A jury found a driver and the manufacturers of a seat belt were not to blame for a passenger’s head injury and paralysis. In 2012, Terry Herbert, then 58, was a passenger in a Ford Fusion driven by Sylvia Caceres when it was involved in a rollover crash. Herbert suffered a traumatic brain injury and was rendered a paraplegic when she was ejected from the car. Herbert claimed that Caceres failed to maintain proper control of the car and that the seat belt’s buckle was defectively designed, causing it to unlatch during the crash. Caceres claimed another vehicle caused her to take evasive action, and Ford Motor Co. and the manufacturers of the Takata AB buckle claimed Herbert was not wearing her seat belt at the time of the crash.

    Driver found not to blame for pedestrian’s alleged injuries

    A jury found the driver of a reversing vehicle in a parking lot was not to blame for a pedestrian’s alleged injuries. On Feb. 7, 2013, Peter Ly, then 35, was in a parking lot inspecting damage on a vehicle when his right shoulder was allegedly struck. He claimed the vehicle he was inspecting was struck by Paul Fleming’s vehicle as it was backing into a parking spot. Ly claimed his shoulder was subsequently struck, resulting in a superior labral tear. Fleming claimed that he back into the spot at idle speed and bumped the parked vehicle, but that he didn’t see Ly until he returned with the property owner. Defense counsel argued that Fleming acted reasonably and that Ly was not behind the vehicle at the time of the accident. Defense also claimed Ly was not injured.

    Once well, if he uses the tools he has practiced and learned to use at a Narconon center, a Narconon graduate can stay well. This is not theoretical. There are four decades of graduates who will swear by it.

    If graduates do run into serious difficulties, they return to their Narconon center where they inevitably find a specific part of the program that they earlier failed to fully understand and therefore could not apply in the travails of daily life. But the majority get it the first time through.

    The Narconon program takes four to six months. During this time, some might consider the Narconon program a “therapeutic community,” but it would be more appropriate to say that Narconon students are going “back to school”–this time to get real tools for real life.

    “The addict has been found not to want to be an addict, but is driven by pain and environmental hopelessness…. As soon as an addict can feel healthier and more competent mentally and physically without drugs than he does on drugs, he ceases to require drugs.”

    • Who knows he is, in fact, capable of living a drug-free life thereafter;
    • Who has improved his or her ability to learn and thus can accept new ideas on how to change life for the better;
