Despite Hardhats, Traumatic Brain Injuries Still Common on Construction Sites

Although hardhats are a fixture in construction work and are intended to keep construction workers safe, they do not always prevent accidents that lead to traumatic brain injury (TBI) on construction sites.

TBIs occur when a bump or blow to the head, or a penetrating head injury, causes an injury that disrupts the normal function of the brain. A TBI can be mild or severe, with concussions being the most common TBI, according to the Centers for Disease Control and Prevention. These injuries may resolve over time – or they may affect an injured person for the rest of his or her life.

While hardhats provide the best hope of protection from TBI, they can’t protect you if you don’t wear them at all times or if you wear an inferior or damaged hardhat. Sometimes TBIs happen even though someone is wearing proper head protection, much in the same way football players can sustain a concussion despite wearing protective helmets.

The construction industry is one of the most dangerous work environments. A study of U.S. workplace-related TBIs published in the American Journal of Preventive Medicine found the construction industry had the highest number of TBIs on the job.

Investigators from the National Institute for Occupational Safety and Health’s Division of Safety Research used data from the Census of Fatal Occupational Injury (CFOI), coupled with the Current Population Survey, to determine that the construction, transportation and agriculture/forestry/fishing industries account for half of all workplace TBI fatalities.

According to the Occupational Safety and Health Administration (OSHA), the fatal injury rate for the construction industry is higher than the national average and has the dubious distinction of the worst risk for TBIs. Hazards for construction workers include falls, trench collapses and scaffold collapses, all of which can lead to TBI. OSHA estimates 25,000 injuries and as many as 36 deaths are caused by falls on stairways and ladders on construction sites during a typical year.

OSHA calls for workers to wear head protection when there is the potential for falling objects from above. bumps to the head from fixed objects or accidental contact with electrical hazards.

Some TBIs happen in instances in which workers might think they don’t need hardhats. For example, falls have become the leading cause of TBIs, followed by car accidents. According to the Brain Injury Institute. 20 percent of TBI-related workplace injuries come from falls that occur on surfaces that are uneven, wet or have an out-of-place object. All of these situations could easily occur on a construction site.

8 Essential Steps for Doing a Construction Project Quality Audit #construction

Your Project Quality Plan is in place. You think all contingencies are covered. You assume inspections are being conducted correctly. You figure your plan is being followed, your customer is happy, and your project is flowing smoothly, right?

That’s why it’s important to conduct a project quality audit. Your audit will show you what’s working and what’s not — so that you can get your project quality on track.

What is a quality audit?

It’s one of the basic elements of an effective quality control plan. A quality audit is a review of how well (if at all) the key areas of your project quality plan are being followed. And, whether it’s effective in getting you the quality results you expect.

It’s basically a fact-finding mission and should be part of your regular monthly routine.

How to conduct a quality audit

In general, you’ll be making field observations, talking to customers and project personnel, and reviewing QA/QC records and reports.

The audit doesn’t only cover your work. Since your quality plan covers all project participants such as subcontractors, suppliers, and other outside services, your audit should include them as well. Keep in mind, many sub-contractors and project owners conduct their own inspections, and they can give you important information for spotting quality issues.

8 Steps to follow to conduct your project quality audit

Here are the steps you should follow as you conduct your audit.

1. Talk to customers

It’s highly likely that your customers are performing their own inspections. Talk to them about their inspection results. Ask them to walk the jobsite with you to do a field quality review. If that’s not possible, you’ll still want to ask your customers a few questions such as:

  • Are there any quality issues that they’ve found
  • Are their expectations being met

2. Walk the jobsite – do your field quality review

You’re probably already walking the job site and observing the way workers do their jobs. For your audit, pay close attention to the following areas:

  • Is their workmanship the quality you expect
  • Are workers following the correct procedures
  • Do they show that they have the skills needed to do the job
  • If you’re dealing with lot controlled materials, do you see the lot identification markings

3. Review quality records and reports

Next, make a trip to the project field office and look at your project QA/QC documents and records. There are two reasons for this part of the audit. First, you want to see if your superintendents and project management personnel are completing and filing all the needed records and reports. Second, you want to check to see that they’ve completed them correctly.

4. Reinspect work tasks

Now, grab a few reports. It’s time to see if your inspectors have been doing a good job inspecting (aka inspector qualification). With your sampling of inspection and nonconformance reports in hand, go out and reinspect the work that’s already been inspected. Compare what you see on the report with your own observations.

  • Is there anything they’ve missed
  • Have the repairs and punch items been reported correctly

5. Talk to field personnel

The next step is to talk to your field personnel to see if they’re properly trained and following the correct procedures. You also want to learn about the standards, specifications, and drawings they’re using (or in some cases, not using).

A good way to conduct this part of the audit is to ask simple open-ended questions such as, “How do you know the right way to install an HVAC air handler?”

Here’s what you want to know:

  • What training have they been given
  • Do they have the necessary certifications if required
  • Do workers have easy access to project standards, specifications, drawings, and change orders
  • Are they using up-to-date standards and specs

6. Follow-up on previous audit action plan items

Follow up to see that progress is being made on previous audit action items. Each month, you should see improvements in your project quality and find fewer deficiencies.

7. Record your findings

Create an audit report and record your findings.

Keeping records will protect your company should future problems arise. It will demonstrate due diligence and your follow up will show that you’re making corrections to issues found.

8. Create an action plan

Finally, create your action plan. In order to figure out how to get better results, you’ll need to understand why your plan isn’t being followed fully. Maybe you need to reinforce the importance of following the plan. Could it be that your construction quality control plan is too complicated to follow? If your quality plan is being followed, are you getting the quality results you’d expected?

Once you know the issues, decide on a course of action and a plan to carry it out.

Conclusion

Auditing your project quality is an ongoing process. Whether you follow a formal, highly structured process or a more casual, less structured approach, you need to regularly audit the implementation and effectiveness of your project quality plan.

In time, all of your projects will get the quality results you expect — and with much less effort need from all project personnel.

Do You Need Bond Protection?

What is a bond?

In simple terms, a bond is an instrument that compels payment of a specific sum of money. A bond imposes an obligation upon an individual to pay a specific sum of money to another person on a fixed date.

Bail Bonds

The term “bail bond” is often seen used. What are bonds in the context of bail law? Bail is the surety/ money a defendant or pays in order to ensure the appearance of the defendant in the court on a later day. A bail bond compels payment of bail amount. In order to help defendants who cannot afford to pay the bail amount, there are entities such as bail bonding agents and bail bond companies. A bail bonding company acts as a surety for the appearance of defendants and issues bail bonds. On the assurance of a bail bond company, a court will allow the defendants to go free. In return, bail bond companies charge a percentage of the amount of the bond and also require the defendant to furnish collateral security. The company issuing the bail bond surety has to pay the bond as a penalty if the defendant fails to appear on the specified date in the court. If the bail bond agent believes that the defendant s/he bailed out is about to flee, s/he can cancel the bond performance and arrest that defendant. Bail bond agents are licensed and bonded by state law.

In the context of bails and bonds, a surety bond is a type of security bond given for the amount of the bail and guarantees an accused person’s return to court. In finance, a surety bond is a bond in which one party promises to pay a specified sum to the other party if a third party fails to meet some obligation. In either case, a notice of bond should be filed before making claim on a surety bond.

Surety bonds may be of different types depending upon their field of use. A surety bond issued by an insurance company in order to assure completion of a venture by a contractor is called a performance bond. Another type of surety bond is a construction bond. It is issued by investors to protect themselves against any failure in completion of construction by builders. A payment bond is a surety bond issued by a contractor to guarantee payment to sub- contractors.

Other Bonds

There are also other forms of bonds like bid bonds, fidelity bonds, and license bonds. A bid bond is issued for the purpose of providing an assurance to a project owner to the effect that the bidder will undertake the job. Fidelity bonds are insurance bonds that protect policy holders from losses. A license bond is a mandatory bond for securing a license to pursue some business or profession.

An appeal bond is a bond given when a judgment is appealed. It is given as an assurance of payment of the original judgment amount. An appeal bond is given at the time of filing a notice of appeal or after obtaining the appeal order. Another type of bond filed at the time of appeal is the supersedeas bond. It is filed by an appellant to delay payment awarded in the original judgment pending the appeal.

Answer: When the defendant released on bail misses a court appearance on the specified date, the court will schedule a forfeiture hearing and the date will be given by a notice to the defendant, bail bonding agents, the bail bonding company and other parties involved. If the defendant fails to appear before the forfeiture hearing the bond performance will be canceled and bond will be forfeited.

Bail bond exoneration is a legal process in which the liability for the amount of bond is discharged. A bail bond is exonerated if the defendant appears in the court at the specified dates. It is done after the adjudication. When a bail bond is exonerated, the bail bond company will not have any future financial obligation in relation to the defendant’s case.

However, under New York Labor Law statutes 200, 240, and 241-6, construction workers should be protected from these dangers by the property owners and general contractors in charge of a construction project. It is the responsibility of those in charge of a construction site and project to provide safe working environments to workers so as to mitigate the chances of an accident occurring. However, when an accident does occur, construction workers in New York may be able to receive greater compensation and protection due to the following labor law statutes:

Labor Law Section 200 – This section of the labor laws states that any property owner or general contractor who had reasonable control over a construction site or project and the conditions under which the workers operated may be held liable for injuries and construction site accidents that occur when the accident was the result of a hazardous condition that they should have been reasonably aware or made aware of. This does exclude blatantly obvious or apparent dangerous situations, such as exposed hanging dangers on which a worker could hit his or her head.

Labor Law Section 240 – This section protects construction workers in the event of a gravity-related construction site accident. According to this section of the law, contractors and owners, barring single- or two-family home owners not directly in control of the work being performed, are required to provide safety provisions, such as scaffolding, ladders, and hoists, to adequately protect workers from both falling from great heights or having objects fall on them. In gravity-related accidents, contractors and property owners can be held strictly liable for an injury.

Labor Law Section 241-6 – This section states that property owners, with certain exceptions, and general contractors are obligated to provide safe construction sites to workers and that this duty cannot be placed on another party (is non-delegable). This includes providing safety equipment and safe tools and appliances. Under this section, the owner or contractor must have had sufficient control over the site and the work being performed in order to be liable.

Education Requirements

The U.S. Bureau of Labor Statistics (BLS) notes that most plumbers are trained through apprenticeships, because these programs offer the most comprehensive training in the field (www.bls.gov ). Apprenticeships may be available through local branches of contractor organizations and unions, like the National Association of Plumbing-Heating-Cooling Contractors and the United Association of Journeymen and Apprentices of the Plumbing and Pipefitting Industry. Programs generally last 4 to 5 years and combines classroom instruction with paid, on-the-job training.

In-Class Instruction

Classroom training generally lasts between 500 and 750 hours. Coursework begins with Occupational Safety and Health Administration (OSHA) safety training courses. First-year requirements may also include completing first aid and cardiopulmonary resuscitation (CPR) training. Thereafter, apprentices take courses in mathematics, blueprint reading and plumbing basics, including instruction on pipes, valves and fittings. Intermediate courses in apprenticeship programs often cover a host of topics ranging from gas lines to bathtubs.

On-the-Job Training

Most apprenticeships require completing 7,500 to 8,000 hours of on-the-job training. Working with journeymen and master plumbers, apprentices learn to cut holes in studs, walls and floors, as well as install piping and fixtures. They’re trained to use soldering irons and power tools, like reciprocating saws. Additionally, apprentices receive instruction in plumbing and building codes, dealing with clients and answering questions for inspectors.

Licensing

Once formal training is complete, apprentices become journeymen plumbers. Most states require journeymen plumbers to be licensed. Although requirements vary, the BLS reports that most states require 2 to 5 years of experience and successful completion of a state board examination. Continuing education is generally required in order to keep the license current.

Career and Salary Information

The U.S. Bureau of Labor Statistics (BLS) estimates a faster than average job growth for plumbers, steamfitters and pipefitters during the years 2014 through 2024. These workers earned $50,620 as a median annual wage in 2015, according to the BLS.

Individuals planning to enter this rapidly-growing career field can take related vocational courses in high school to prepare for their career. After high school, aspiring plumbers are trained through a 4-5 year apprenticeship program that combines classroom work with hands-on experience. Most states then require journeyman plumbers to meet experience requirements and pass a competency exam for licensing.

In the 1930’s, Howard Petersen was a plumber’s apprentice, moonlighting as a race car driver. This was back in the days of open cock pits in racing and lead pipe in plumbing. After serving in World War II as a pipe fitter, Howard came home to work for a series of small plumbing shops.

In 1947, Howard and his Brother George made a decision to strike out on their own. They bought out Bill Mack and opened a small shop on West 3rd Street in Davenport. It was 1947 and the company vehicle was a very used 1934 Dodge panel truck.

Petersen now owns 50 separate company vehicles, not including seven back hoes and other pieces of equipment. Today, that tiny two-man operation can have nearly 100 persons on the payroll at different times of the year depending on the projects involved.
