Options to Respond

If you have been served with a summons and a petition, you are the respondent in a court case for divorce or legal separation.

When you are served, read the papers you have received carefully. The Petition (Form FL-100 ) tells you what the petitioner (your spouse or domestic partner) is asking for. The Summons (Family Law) (Form FL-110 ) gives you important information about your rights and the divorce or separation process. It contains some standard restraining orders limiting what you can do with your property, money, and other assets or debts. It also prohibits you or your spouse or partner from moving out of state with your children from your marriage or partnership, and from applying for a new or replacement passport for any of your children together, without the prior written consent of the other or a court order. READ this form carefully!!

Once you are served, you have several options:

  1. You can do nothing — which means that whatever your spouse or domestic partner is asking for in the Petition will probably be granted. The judge will base his or her decision about property, support, and custody and visitation (if you have children together) only on what your spouse or domestic partner has requested in the Petition.
  • This situation is called a “true default” because you are “defaulting” by not responding and are not involved at all.
  • In a “true default” you are giving up your right to participate in the case.

  • You can do nothing because you have a written notarized agreement with your spouse or domestic partner where you both agree to end your marriage or domestic partnership. And you agree about other things like the division of your property and your debt, spousal or partner support, and, if you have children together, child support and custody and visitation orders.
    • In this case, you also “default” because you are not filing a response.
    • BUT you are having a say in the final outcome because you are reaching a written agreement with your spouse or domestic partner. So this is a “default with agreement” case.

    • If you choose this option, it is considered an “uncontested” case because you and your spouse or domestic partner are not fighting over the issues. You are agreeing to the terms of your divorce or legal separation.

    • This situation is considered a “contested” case since you and your spouse or domestic partner do not have an agreement and will need the court to make decisions in your case.

    Welcome to the Counseling Center

    END OF THE SEMESTER SESSIONS

    Each semester, when the Counseling Center has no more capacity to add new clients seeking ongoing counseling, we replace initial consultations (ICONs) with one-time sessions for the remainder of the semester. As of Monday, July 31 st the Counseling Center will begin offering one-time sessions. These one-time sessions are an hour in length and focus on problem solving more immediate issues. If students are in need of further services, we will help them connect with additional resources outside of the Counseling Center.

    Counseling Center services are free, confidential, and provided by trained professionals to currently enrolled Texas State students while classes are in session.

    Counseling Center Services include brief individual, group, and couples counseling, consultation and crisis response, and workshops about coping with stress and other mental health topics.

    Individual counseling is also available on a limited basis at the Round Rock campus. Click here for details.

    CONCEALED CARRY IS PROHIBITED IN THE COUNSELING CENTER

    Effective August 1, 2016, concealed carry of a handgun by license holders is allowed on Texas public university campuses subject to the restrictions imposed by statures and by the University President.     Extended Auto Warranty Companies Reviewed

    Finding the best plan at the right price is not easy so you’ll have to take time to shop around. Of course you have to first decide if you actually need the warranty. This will depend on personal preferences and how much of the future risks you are willing to take care of. While most cars will require numerous repairs for as long as you own them, some will need no more than routine maintenance. Then there are those that will require unexpected but very expensive repairs. Just like when purchasing a vehicle, the best way is to compare different options on the internet. Fortunately, there are independent companies that review and rate extended auto warranty providers for clients.

    Extended auto coverage is available for new as well as used cars. Since new cars come with a factory warranty, the need for extended coverage largely depends on how long you intend to keep the vehicle. For example, most factory plans usually last three years or up to 36,000 miles. Now if you intend to keep the car for two or three years, purchasing an extended warranty may make little sense. However, if you plan on keeping the car for a long time after the factory warranty expires then it’s a good idea to extend your protection. If buying a used car, there is a high probability that the factory coverage plan will not be transferable or will have expired so you’ll need extra protection.

    It’s always good to know what is covered, and what’s not covered by the Vehicle Service Contract you intend to buy. Does it cover wear and tear? What about breakdown? Under breakdown, some warranties cover only the parts that break. But you know well that not all parts fail due to breakdown so such a policy will be less inclusive than is desirable. Some policies extend coverage to parts that wear out with time under the “wear and tear” subtitle. Again, not all extended policies have this feature. Some contracts do not cover ABS brakes and most of them don’t cover overheating. Transmission, engine, seals and gaskets, drive axle assembly and turbocharger/superchargers will usually be covered, though it is better to fully explore specific options before committing to a plan.

    Some companies require that you pay the repair and submit a receipt to the warranty provider for reimbursement. While this is not a bad idea, you may sometimes have to wait for weeks or even months before you get your money back. Then there are those that pay the repair shop directly and almost immediately. For purposes of convenience, never purchase warranties that don’t pay the shop directly.

    Residential Treatment Programs

    R ESIDENTIAL or In-Patient Programs usually require a commitment of at least 30 days and typically include room and board. Through intensive counseling and group interactions, addicts/alcoholics learn how to regain control of their lives using key recovery tools. Most programs follow the 12 steps of AA. Some residential programs are staffed to provide addicts with detoxification services to help through the early stages of withdrawal.

    The goal of all recovery programs is to help the addict recover from drug/alcohol abuse by addressing the underlying issues that contribute to addiction. These programs remove the addict from the environment and acquaintances that enabled their addiction allowing the recovering addict to focus on their addictive behavior instead of their drug use.

This involves speaking with employees and supervisors so the analyst can recommend a plan of action, whether it be to attempt to improve skills employees may be lacking, replace current employees, or hire new employees to better distribute workloads. The human resource analyst reports their findings to company management and recommends ways to use the information to the benefit of the company.

    A human resource analyst usually works a standard 40-hour workweek in an office environment. They are part of a human resource team and frequently interact with other members of the team to acquire data.

    To become a human resource analyst, a bachelor’s degree is required, usually in human resources, industrial psychology, business, or a related field. In addition, employers frequently request candidates have two to five years of experience working in human resources. Also, most human resource analysts are expected to be familiar with Human Resources Information System (HRIS) software.

    • May assist with payroll administration.

    The Human Resource Division’s statutory responsibilities can be classified in the following areas:

    Provide for personnel hearings, support to the compensation commission, establish, administer and promulgate reasonable rules for personnel classification systems, compensation plans, applicant selection and recruitment systems, and performance appraisal systems.

    The Human Resources Division (HRD) offers assistance to the Executive Branch Agencies, the Legislative Service Office, the University of Wyoming, Community Colleges and the Citizens of Wyoming. Twenty-two full time positions carry out their part of the strategies, which involve hearings, grievances, state and federal employment law interpretation, record retention, rule interpretations, personnel database entry, position control, selection, recruitment, training, pay determination, position classification, group insurance plans, and other benefits provided through the State Personnel Rules.

    The Human Resource Division is working closely with all state agencies to develop and implement an Employee Development System which incorporates work force planning and a competency based performance appraisal system. This process will involve agencies identifying the skill sets needed to meet the needs of their customers and then working with employees to ensure they have the skills needed to meet requirements of the job. This process, along with the compensation plan, will assist the Division in addressing the issue of turnover in state government. One of the goals is to decrease turnover in state government by being able to better position employees to be successful in their jobs and paying them competitively.

    The Human Resource Division develops and maintains a state wide selection process that aims to provide the highest qualified individuals to meet the needs of the state agencies. Also, assistance is provided to agency managers, employees and applicants in ensuring compliance with numerous state and federal legal and administrative requirements (EEO, FLSA, ADA, etc.). The section maintains a performance appraisal system for the Executive Branch agencies.

    The Human Resource Division defines job knowledge, skills and abilities required by state jobs for relevant recruitment, classification, training and development. It also administers a mechanism for movement within each pay grade, in conjunction with the Compensation Commission; evaluates and defines job parameters, performance measures and pay according to market; surveys a relevant labor market that represents public and private sector employers; and maintains a competitive posture with other states and public entities on benefits available and costs to the state. This is accomplished through completion of annual benefits surveys and promulgation of rules pertaining to employee benefits.
