Options to Respond

If you have been served with a summons and a petition, you are the respondent in a court case for divorce or legal separation.

When you are served, read the papers you have received carefully. The Petition (Form FL-100 ) tells you what the petitioner (your spouse or domestic partner) is asking for. The Summons (Family Law) (Form FL-110 ) gives you important information about your rights and the divorce or separation process. It contains some standard restraining orders limiting what you can do with your property, money, and other assets or debts. It also prohibits you or your spouse or partner from moving out of state with your children from your marriage or partnership, and from applying for a new or replacement passport for any of your children together, without the prior written consent of the other or a court order. READ this form carefully!!

Once you are served, you have several options:

  1. You can do nothing — which means that whatever your spouse or domestic partner is asking for in the Petition will probably be granted. The judge will base his or her decision about property, support, and custody and visitation (if you have children together) only on what your spouse or domestic partner has requested in the Petition.
  • This situation is called a “true default” because you are “defaulting” by not responding and are not involved at all.
  • In a “true default” you are giving up your right to participate in the case.

  • You can do nothing because you have a written notarized agreement with your spouse or domestic partner where you both agree to end your marriage or domestic partnership. And you agree about other things like the division of your property and your debt, spousal or partner support, and, if you have children together, child support and custody and visitation orders.
    • In this case, you also “default” because you are not filing a response.
    • BUT you are having a say in the final outcome because you are reaching a written agreement with your spouse or domestic partner. So this is a “default with agreement” case.

  • You file a response with the court but also reach an agreement with your spouse or domestic partner about all the issues.
    • If you choose this option, it is considered an “uncontested” case because you and your spouse or domestic partner are not fighting over the issues. You are agreeing to the terms of your divorce or legal separation.

  • You file a response with the court in which you disagree with what your spouse or domestic partner is asking for.
    • This situation is considered a “contested” case since you and your spouse or domestic partner do not have an agreement and will need the court to make decisions in your case.

    Creating S.M.A.R.T. Goals

    Specific: A specific goal has a much greater chance of being accomplished than a general goal. To set a specific goal you must answer the six W questions:

    *Who: Who is involved?

    *What: What do I want to accomplish?

    *Where: Identify a location.

    *When: Establish a time frame.

    *Which: Identify requirements and constraints.

    *Why: Specific reasons, purpose or benefits of accomplishing the goal.

    EXAMPLE: A general goal would be, Get in shape. But a specific goal would say, Join a health club and workout 3 days a week.

    Measurable – Establish concrete criteria for measuring progress toward the attainment of each goal you set.

    When you measure your progress, you stay on track, reach your target dates, and experience the exhilaration of achievement that spurs you on to continued effort required to reach your goal.

    To determine if your goal is measurable, ask questions such as

    How much? How many?

    How will I know when it is accomplished?

    Attainable When you identify goals that are most important to you, you begin to figure out ways you can make them come true. You develop the attitudes, abilities, skills, and financial capacity to reach them. You begin seeing previously overlooked opportunities to bring yourself closer to the achievement of your goals.

    You can attain most any goal you set when you plan your steps wisely and establish a time frame that allows you to carry out those steps. Goals that may have seemed far away and out of reach eventually move closer and become attainable, not because your goals shrink, but because you grow and expand to match them. When you list your goals you build your self-image. You see yourself as worthy of these goals, and develop the traits and personality that allow you to possess them.

    Realistic – To be realistic, a goal must represent an objective toward which you are both willing and able to work. A goal can be both high and realistic; you are the only one who can decide just how high your goal should be. But be sure that every goal represents substantial progress.

    A high goal is frequently easier to reach than a low one because a low goal exerts low motivational force. Some of the hardest jobs you ever accomplished actually seem easy simply because they were a labor of love.

    Timely A goal should be grounded within a time frame. With no time frame tied to it there s no sense of urgency. If you want to lose 10 lbs, when do you want to lose it by? Someday won t work. But if you anchor it within a timeframe, by May 1st , then you ve set your unconscious mind into motion to begin working on the goal.
    Your goal is probably realistic if you truly believe that it can be accomplished. Additional ways to know if your goal is realistic is to determine if you have accomplished anything similar in the past or ask yourself what conditions would have to exist to accomplish this goal.

    T can also stand for Tangible A goal is tangible when you can experience it with one of the senses, that is, taste, touch, smell, sight or hearing.

    When your goal is tangible you have a better chance of making it specific and measurable and thus attainable.

    With some planning you could go WGU and then when you get to 60 credits just apply them to any of the big three for your 2 year. You do not have to take classes with them to get your degree if the credits you have corresponds with their degree plan. There is some cost associated with this method and it doesn’t completely answer your question, but I thought it could possibly be applicable.

Some of the degrees require a capstone of 3 credits, but the rest can all be transferred. Other than that, pay for application, pay for enrollment and pay for graduation. everything else can be transferred. If you want to save money, you can take proficiency examinations for credit. These should be pretty easy since most of them are basic, and you already have some knowledge about Computer Science /Information Systems and the like.     Self-employed? How to get a mortgage

    Being your own boss can come with a host of perks such as setting your own dress code (read: pajamas), a flexible schedule and a cubicle-less existence. But one financial benefit — tax write-offs — morphs into an ugly disadvantage when self-employed workers try to get a mortgage. It’s not impossible to get a mortgage when self-employed, but it definitely requires advanced planning or stepping outside of conventional financing .

    Lending standards are tough

    There are almost 9 million self-employed people in the United States, representing about 6 percent of the nonagricultural workers, according to the U.S. Bureau of Labor Statistics. Many of these people earn a good living but find it hard to qualify for home loans. Borrowers typically have to provide two years’ worth of tax returns, which often don’t accurately reflect the take-home pay of self-employed people.

    “How we qualify self-employed doesn’t always agree with how the IRS says you can run your business legally,” says Pava Leyrer, training and development manager at Northern Mortgage Services in Grand Rapids, Michigan. “So they are finding it harder to get a loan unless they want to show more income to the IRS. It’s a fine balance.”

    Returns don’t reflect true income

    Self-employed people can take advantage of a slew of tax deductions related to their businesses, from retirement plans to business meals and entertainment to interest on business loans or business credit card interest. It reduces their taxable income, so Uncle Sam doesn’t empty their pockets at tax time.

    But when mortgage underwriters look at tax returns for proof of income, they see income after business expenses have been deducted. The result often is a much lower figure than what the self-employed person actually takes home. This could reduce the loan amount that the borrower can qualify for, or even result in rejection.

    “If they are making money and the tax returns don’t show it, I can’t help them,” says John Stearns, a senior mortgage banker at American Fidelity Mortgage in Wisconsin.

    Some lenders understand

    In some cases, mortgage lenders will allow certain deductions to be added back to the income such as depletion, depreciation or a large, nonrecurring item, Leyrer says.

    “I had a customer who owned a restaurant with a liquor license. He wrote off $90,000 for a one-time expense for the license,” she says.

    Plan ahead before borrowing

    If you’re self-employed, Leyrer recommends that you prepare longer than most borrowers before buying a home. The easiest way is to write off fewer expenses in the two years leading up to the big purchase. Clean up your finances so that your business doesn’t commingle with your personal funds. For example, pay for a computer using a business credit card rather than a personal one, because some lenders may not count that debt against you because it belongs to the business, she says.

    Show year-over-year increases

    Also, choose your years carefully. While lenders will ignore seasonal spikes and valleys in income by averaging out income over 24 months, they won’t like seeing a decline in income from one year to the next.

    “By definition, these businesses can be highly volatile,” Stearns says, “so if one year shows income and the next year shows half as much, that could be a problem. You want to show an increase from year to year to show that business is good.”

    Or choose the bummer option

    If those moves don’t help you get a home loan, you may need to enlist someone who has high enough income on their tax returns as a co-signer on the mortgage, says Dave Norris, president and chief operating officer of loanDepot.

    “Or, look at a smaller loan that is easier to qualify for,” Norris says. “If the goal is an investment, then get into a mortgage by buying a condo or townhome.”

    A new type of loan is developed

    Another option for self-employed workers is getting an “alternative income verification loan,” the more responsible cousin of the “no-doc” and “stated income” home loans from housing’s go-go years. So far, only niche lenders, such as Western Bancorp, offer these.

    The company qualifies self-employed borrowers using 12 months’ worth of business bank statements and personal bank statements to create a cash-flow analysis.

    “We determine how much positive cash flow this person has,” says Rick Soukoulis, chairman and CEO of Western Bancorp. “Borrowers also must provide a profit-and-loss statement to match to the bank statements.”

    Western Bancorp requires a minimum credit score of 620. Maximum loan-to-value is 75 percent up to $1 million and 65 percent to $2 million. The interest rate is about 1 percentage point higher than a conventional fixed-rate mortgage, and it is structured as a 5/1 adjustable-rate mortgage. The mortgage is available only in California and through mortgage brokers.

    “We brought it out about a year ago because there were 1.7 million self-employed borrowers in California who couldn’t get financing,” says Soukoulis. “I think it will become mainstream in the next few years.”
